Harmonisatie van Europees procesrecht

Deze bijdrage ziet op de harmonisatie van het Europees procesrecht en meer aan het bijzonder aan het voorstel voor een Europese betalingsbevelprocedure binnen het kader van de vragen die in deze bundel centraal staan. Deze betreffen de doelstelling van eenvormig bedrijfsrecht en de verhouding tot het Nederlandse recht. Aandacht wordt achtereenvolgens besteed aan de Europese harmonisatie van het IPR en het procesrecht, de doelstellingen van het voorstel voor een Europese betalingsbevelprocedure, het toepassingsgebied en de procedure en de verhouding tot het Nederlandse recht. Voorts wordt aan de hand van een aantal opgestelde criteria de vraag beantwoord of de voorgestelde eenvormige procedure tot ‘beter’ recht leidt. In de conclusie worden de in inleiding van deze bundel geformuleerde elf vragen betreffende het centrale thema (doelstellingen van eenvormig recht en verhouding tot het Nederlandse recht) beantwoord en samengevat. Abstract: [Harmonisation of European Procedural Law. The proposal for a European Order for Payment Procedure] This contribution concerns the harmonization of European civil procedural law, more in particular the proposal for a European Order for Payment Procedure, within the framework of the central questions of this book. These concern the objectives of uniform business law and its relationship with Dutch law. Attention is paid to the European harmonization of private international law and procedural law, the objectives of the proposal for a European Order for Payment Procedure, its scope of application, the procedure and the relationship with Dutch law. Furthermore, on the basis of a number of criteria the question is answered whether or not the proposed uniform procedure will result in a 'better' law. In the conclusion the eleven question regarding the central issue (the objectives of uniform law and the relationship with Dutch law) are answered and summarized.
