The article (in German language) deals with the freedom of EU Member States to conclude international treaties amongst each other (or a subset of each other) within the legal framework of EU law. It develops a methodology to assess whether limits set by EU law are crossed and which legal consequences are to be attached to this. The contribution applies its findings to the Fiscal Compact.
