Dit artikel bouwt voort op de ontwikkelingen betreffende voorlopige en bewarende maatregelen die eind jaren 90 in de rechtspraak van het Hof van Justitie plaatsvonden (Van Uden/Deco-Line, Mietz) en behandelt nieuwe ontwikkelingen in de periode 2001-2003. Aan de orde komen art. 12 EEX II, art. 13 en art. 4 lid 2 Rv, de implementatie van art. 50 lid 6 TRIPs en de Hermes uitspraak van het HvJ in het nieuwe art. 260 Rv, de Italian Leather uitspraak van het HvJ en nationale rechtspraak (met name Spray/Telenor). Abstract: [Provisional and Protective Measures in International Perspective – New Developments (2001-2003) This article builds on the developments concerning provisional and protective measures in the case law of the European Court of Justice at the end of the 1990 (Van Uden v. Deco-Line, Mietz) and deals with new developments in the period 2001-2003. Attention is paid to Art. 12 Brussels II Regulation, Art. 13 and Art. 4 para 2 Dutch Code of Civil Procedure, the implementation of Art.50 para 6 TRIPs Agreement and the Hermes ruling of the ECJ in the newly introduced Art. 260 Dutch Code of Civil Procedure, the Italian Leather ruling of the ECJ and Dutch national case law (esp. Spray v. Telenor).
