Abstract
In an unprecedented ruling a Dutch Appeal court concluded national anti-tobacco legislation contrary to the Framework Convention on Tobacco Control.a This ruling demonstrates the importance of the Convention in the Netherlands by banning any restrictions on smoking in public places.
